Lasting Power Of Attorney

Just wondered if any members had used the Gov online LPOA forms to register the application instead of going through a solicitor and comment on the ease of use etc .

I tried last year, but there are so many hoops that you have to jump through, in the end I paid a Solicitor to get it completed and lodged with the OPG.

What is most off-putting is that you only have to miss one bit of info or not tick one box and they back the whole damn lot to you. It is very time consuming, and in my case took nearly 9 months to get lodged owing to bureaucratic cock-ups and backlogs.

My advice is that if you have the funds, get someone else to do it, and get it right first time. Foraging near Gaydon....

the missus and me are in the process of setting up lasting power of attorney, for each other. Not that we need too at this current time (although I have had cancer twice in the last 5 years) After the problems we had getting one set up for my mother (who had dementia) we have decided to get everything like that in place now. Would not attempt to do it without a solicitor though.

Well its for my mum , I have been mentioning it to her for several months but she has always fobbed me off but said she spoke to a retired Solicitor friend of hers about one a couple of days ago .
She has terminal cancer and currently having radio therapy treatment to minimise pain and discomfort , she has no property or assets and has distributed her small savings pot to her grandchildren already .
She has not made a will but has left instructions for funeral arrangements etc .

Sorry to hear about your mum, from what you have said it sounds like an LPA may not be necessary, but I would speak to a lawyer. Also ask about the need for a will. Although I was the sole beneficiary for my mum, having a will made all the legal bits. so much easier.

Thanks for the replies and advice , just currently discussing it with my wife who has it for her mother , a few months ago my mum would not involve me in any of her personal matters finance/welfare , that has now changed and she wants me to do all i can for her .
Financial issues are sorted , social services for ongoing care I regular have contact , I will speak again to her about it this weekend .

I know a lady who is in her 60's and in good health, her husband has advanced Altzeimers and is in a home. They set up a POA (don't know what sort or any details) so that she can can have access to his finances. She now wants to move to a smaller house near her children but found that she can't actually sell the house (in joint name) without his signature/permission. She thought that everything had been set up properly by her lawyers but apparently it doesn't cover everything. 3 x FL1 2 manual + 1 auto
5 x FL2 4 manual + 1 auto

I have done three of these recently for various elderly relatives all using the online forms and guidance.

The solicitor wanted 」400 for processing each type (Health and welfare + Property and Financial)

My first attempt took quite a lot of time and a lot of reading of the guidance notes but is actually quite straight forward. I made a mistake with the dates and it was rejected, but quite easy to correct and amend

by the time I got to my third and understood all the principals involved, it was a breeze and only took a few hours to complete.

The information and forms are all available online. The guidance notes are very comprehensive and explain the implications of certain answers and also give examples. Read everything thoroughly to make sure you understand how the system and safeguards work. It is all designed so it can be done by a non professional

Also......get them registered while the donor is still capable. Do not leave it too late

Lurcher, sorry to hear about your mum. The process, as already said is a bit complex but working through it carefully is very possible.
It sounds on the surface as if it might not be so important but I know just how difficult it is to do the simplest things without LEA if you have to deal with any aspect of her income / pension / benefits, so worth it despite what you say about her financial position.

Even more important is the care aspect, especially in these circumstances. Get the LPA care, and know her wishes so that you are not in the position of having to deal with hospital or care staff about her care but without anything other than moral authority! You may never need it but it's priceless to have if you do. Get both registered immediately.

Tough place to be, I wish you and your mum all the best.

I did the financeLPA online for my Dad who is 85. Very easy on line, you can save and go back later.

All seemed straightforward, just carefully follow the instructions.

We set up both Financial and Welfare POAs for both our parents. It takes a while and one has to be careful not to miss anything but it is perfectly doable if you have the time and patience. We found the most time consuming bit was after they are registered was getting them accepted by the various financial institutions - banks etc. when one also has to prove ones own identity with the usual bills, driving licence, passport etc. Each one can take up to an hour as they fill in their own forms and copy the registered POAs.

A friend of ours paid a solicitor 」2,000 to set up POAs which I think is outrageous!

Once done it does make life easier.
