WHAT AN IDIOT :'(

I reversed today and somehow didn't see the vauxhall viaro behind me, I was in a land of my own! Even the beeps didn't register in my brain. I'm so annoyed with myself! My beautiful baby is mostly fine with a little scuff however the rear of the vauxhall is caved in on the door and scratched. To make matters worse its a rental! The owner wasn't in at the time but I went and told his wife Sad. AHHH! do not want to lose my NCB :'(.

You are not alone, Chris. Just before Christmas I was working late. When I moved the car out of the yard, I backed into a steel gate post I knew was there - and the beeps told me too! Only damage to the rear bumper and my pride however. B Censored r! Must get around to getting it fixed sometime..... 10MY (Sept 09) TD4 HSE Auto in Stornoway Grey (Now Gone)

Sorry mate. As it's a rental it will almost certainly be an insurance job. Sounds costly too!
I can guarantee mine won't go through your insurance however! I will likely get a bumper off flea bay some time. Just looking for a rimini one with beeper holes..... 10MY (Sept 09) TD4 HSE Auto in Stornoway Grey (Now Gone)

Sorry to hear that.

On another similar note I got a tip from my criminal law lecturer tonight. If you were to be stuck in traffic and as you crept forward you lost concentration and shunted the car in front you are technically driving without due care and attention. If the other driver and/or the police quiz you about it (which they will), tell them you sneezed.

Per the authority of Hill v Baxter [1958] 1 QB 277 "...if a swarm of bees enters your car and causes you to crash, you are not guilty of a driving offence; your action was involuntary; a reflex action."

The principle applies to sneezing Thumbs Up

As they say in latin: Actus non facit reum, nisi mens sit rea. Which in laymans terms basically means: An act is not necessarily a guilt act unless the accused has the necessary state of mind required for that specific offence LL.B (Hons) - University of Derby

Each is case is judged on its merits, the case was cited merely for its principle. I haven't read the entire case so I will ask my lecturer what the grounds for appeal were.

It's a bit like citing Sym v Stretch 1936 2 All ER 1237 for the best definition of a defamation by Lord Atkin. In that case, the claim was defeated but it still stands as the definition. LL.B (Hons) - University of Derby

no court needed for that offence in CG land, summary execution at the road side. Sadly in order to stop the vanners the police have to overtake them first, not easy Confused At work
