As has been said, perfectly legal.

However, road markings of this type are designed to separate traffic, and to protect traffic turning right. The Highway Code s6(130) states that road users "should not enter the area unless it is necessary and you can see that it is safe to do so."

So, in summary, perfectly legal - but if you choose to enter an area marked like this (assuming you have crossed a broken line, rather than a solid one) then you'd best be sure that you've got the time, space and room to complete the manoeuvre safely.

I guess the trip up there for the Corsa could be 'necessary.' 60 up there so IF he was exceeding that in order to get by, then it hardly seems necessary. 'Safe to do so' would depend on how close he was to the filling station when completing the overtake because it is possible that the next car along could brake to turn in or a car could pull out suddenly etc.

In summary, it is legal but I personally would have held off with the approaching filling station. Down hill presents less problems. Thanks for the quote choccy Thumbs Up

I was under the impression that the Higway CODE was just that, a voluntary code, and not legally binding or enforceable, as opposed to the Road Traffic Act, which is?

Have I got it wrong for the last 30 years then? Foraging near Gaydon....

Sort of, but not quite.

The Highway Code makes reference to various parts of legislation (including the RTA). Where a particular part of legislation is referenced, the Highway Code either states "You MUST...", or "You MUST NOT..."

If the Code is simply giving guidance or advice, it states "You SHOULD...", or "You SHOULD NOT..."

As such, the Code is not (in and of itself) part of the legislature, but it is a "handy" collection of the most pertinent points of legislation relating to road safety, together with some overall guidance.

In this particular scenario, the Code stated "You should not enter the area unless it is necessary and you can see that it is safe to do so."

As such, it is making no reference to a particular piece of legislation and the information is given as guidance.

Nevertheless, I suspect that if you were to cause an accident by NOT following a piece of guidance found within the Code (i.e. in this particular scenario, you entered the cross hatching and caused an accident by doing so), the fact you ignored explicit guidance within the code would do you no favours....

if you read the comments and the link to a screen grab of the owner of the companies reply, he took the required steps, the strange thing is, the person driving did this himself, so why have some scroats rang the head office, abused and threatened his staff on the phone and threatened to firebomb them. As a Bike rider when I over take in the same lane as a car etc or down the centre, safer IMO
It's down to me if it go's pear shaped

I do like viewing these video's and agree there are some idiot's out there.

But what is it all about, none of us are angels on the road. we all without exception break the rules sometimes. yes the bike crossed a solid white line. so what Question there was a huge gap and nobody was inconvenienced by his/her actions.

Just saying it how I see it , not trying to upset anyone Very Happy
