I guess the trip up there for the Corsa could be 'necessary.' 60 up there so IF he was exceeding that in order to get by, then it hardly seems necessary. 'Safe to do so' would depend on how close he was to the filling station when completing the overtake because it is possible that the next car along could brake to turn in or a car could pull out suddenly etc.

I was under the impression that the Higway CODE was just that, a voluntary code, and not legally binding or enforceable, as opposed to the Road Traffic Act, which is?

As a Bike rider when I over take in the same lane as a car etc or down the centre, safer IMO
