i always found LR Aftermarket warranty worth the additional cost, all claims paid out and the dealer fighting my corner when speaking with them, X years of LR ownership, this is the 2nd LR his had, services with ourselves all the time

Warranty Wise (linked to the glorious Quentin Wilson, motoring journalist guru)

Confirmation that they cover the Dual Mass Flywheel complete, and that wear and tear is also covered.

Attempt to claim from them for said failed component (slave cylinder leaked as well) and they refuse saying it is not an unexpected total breakdown of the part and deemed to be progressive wear and tear which is not covered. Apparently I shouldn't have driven it with the failed flywheel, WHICH WE DIDNT KNOW FOR SURE HAD FAILED UNTIL IT WAS REMOVED AND INSPECTED AS PART OF THE CLAIM PROCESS!!

then to add insult to injury I have cancelled my policy with them in disgust, having paid 2 payments totalling £300 for under 2 months on cover, but Im not entitled to any refund at all as im outside the 30 day cooling off period.

RAC warranty did the same to me several years ago, when my VCU failed on my FL1. They said it wasn't covered the front/rear propshafts were and refused to pay out.


Main dealer warranties are, from own experiences of LR extended warranty and from what others say, a hell of a lot better

Anyone else (Warranty Direct, Warranty Wise, RAC, AA etc etc etc) are not worth the paper they are written on !!! Evil or Very Mad Evil or Very Mad

In essence, you have breached contract by cancelling, therefore they are not obliged to refund you. I'm sure the Doctor will be able to clarify that?

However, I think that you would be well within your statutory rights to speak with the Consumer Association, CAB etc and get some decent advice. Whilst renowned for wriggling, to hide behind the caveat of progressive wear and tear over general wear and tear takes the proverbial IMHO

My Factory Warranty expires in October this year, and if anything has helped me in my decision, it is a horror story like this! Given that their (WarrantyWise) quotation was only £8pcm cheaper than LR Extended, its a bit of a no-brainer for me. Foraging near Gaydon....

The years cover was just under £600, which was payable at something like £45 p/m, or 4 payments of £149 or a one off payment.
So glad I didn't pay in full up front, but wish I had just paid the £45 p/m instead.

I see what you mean about the breach of contract, but there is a right to cancel the policy at any time. Obviously subject to the daylight robbery small print clauses.

The other annoying thing is that when the claim was first opened with them, they did actually tell me not to drive the car but that they couldn't get an assessor out for at least 10 days. When I queried their 48hour claim turnaround they just said it was from the date of assessment. No suggestion of providing me with a courtesy car as one is only provided for sudden breakdown.

If I had not reported it, and been driving down the outside lane of the M1 at 70mph and the clutch had popped, or the diff had suddenly gone or something more catastrophic, then I could claim then, providing I survived any potential crash caused by the failure.

Im sure their black horse is tied up outside the office, Ive just seen a masked man standing at the front door for a delivery Thud

Made 5 claims in total for my customers, and only 1 has ever been authorised, of which I am still awaiting payment for 6months later... Now, it's not worth the bother

Laughing from my relatively short time on this forum the FL2 only seems to have 1 or 2 major problem areas. (as opposed to the ton of potential problem areas on D3/D4/RRS/FFRR)

and none of them will be covered by slimey after market warranties Whistle

the fact you paid in instalments is neither here nor there, you was still paying for a 12 month policy.

You should be entitled to a pro rota refund, less time on cover and admin fees for cancelling Former Mod/Member, with the most post & Chicken George Arch nemesis

Straying off topic slightly but LR need to up their game in terms of warranty, a lot of manufacturers now offer, 5 and 7 year warranties.

But hey can't expect too much, they have only just cottoned on to offering servicing deals on new cars. 21MY Defender 90 S 3.0 D200

Firstly, with regard to breach of contract, I can only take this at face value as I do not have a copy of the agreement. There would be a breach if you agreed to pay the full amount of £x spread over x months and pulled out of the payment plan.

It seems here that you can cancel at anytime and they will deem your withdrawal of payments as a cancellation so no breach. You were of course covered for the period of this dispute, which brings me on to the next point.

They have said that they cover you for wear and tear end of. Does the agreement list any exceptions to this coverage? Perhaps it says unless such and such happens?

Assuming there are no such exceptions for a moment, they are effectively introducing a new term to which you have not agreed and signed. They are therefore in breach of contract for which you can sue them and demand a repair under the terms that were agreed.

If you brought such a claim, they could say that there is no such breach and that the 'wear and tear' term is open to interpretation and because it is "progressive," it isn't proper wear and tear that they would cover. You can then counter that by saying the term falls foul of the contra proferentem rule.

The contra proferentem rule states, broadly, that where there is doubt about the meaning of the contract, the words will be construed against the person who put them forward.
