Back now so I shall throw a little more wood on the fire...

S.14 of SOGA (satisfactory quality) would be the argument if going down that road. I would argue that the fact that LR have acknowledged it in bulletins and repaired it under warranty for customers, suggests that it is a fault of such significance as to render the car unsatisfactory to the 'reasonable person.' Therefore well worth an argument if the cost is too high.

The great thing is that if the dealer fought it all the way to court and won, it would cost them substantially more in legal fees than it would to cave in and repair it. They won't admit that of course and would at all times come across as confident, hoping that the customer will wave the white flag and go away. Secretly they would be shi Censored ing a brick Laughing

Sadly, customers rarely use the power of SOGA to take retailers on and I can understand why. Lots of hassle and time consuming when it is so much easier and less stressful to cave in and/or go elsewhere and deploy the credit card.

Never any guarantees in the court room but most are settled before then through negotiation. Just for info if nothing else Thumbs Up LL.B (Hons) - University of Derby

Yes its who you buy it from. Who did you buy from? When? and did they offer any warranty in addition to LR warranty?

Not that their warranty matters as warranties are simply an add on to statutory rights. LL.B (Hons) - University of Derby

I bought from perrys in Barnsley, the car was only 2 years old so no extra warranty was offered. They do however own my local LR dealer, Rocar Moores in Huddersfield. Black MY2013 SD4 GS Auto, Wood Company Armrest, Freel2 sticker.

Also, I think even non LR garages do health checks before purchase as a sort of guarantee that you are buying a healthy car. Therefore just 12 months from purchase, this happens and you can show that it has developed the fault!

What would the outlay be to you?

Worth getting an independent mechanic or LR to do a report on the fault and the cost so that you can evidence that. Such costs can be reimbursed because you would put them as damages on your claim form. LL.B (Hons) - University of Derby

Stevie

I bought my previouse car a Jaguar XF from and independent garage, I took it into my Jaguar Dealer to get a service done and a few other jobs looked at as I was having DPF issues.

The Jaguar Dealer were excellent and I will name them Rybrook in Chester, they ran my car through there computer and informed me that the Gear Selector hasnt been replaced it was on Re call for it, they also informed me at the Service that the Port Deactivation Valves on the Turbo's were perished causing the DPF issue and these should have been replaced which they did. They also told me a number of led's in both rear brake light clusters had gone and they would ask Jaguar as a good will gesture can they replace them which they did.

All this work was done by a none supplying garage. ( yes they were probably hoping I would go to them next time for next car ) its there gamble, but the point is find a good dealer strike up a realationship let them know your the customer and the boss and there there to serve ......... sorry but I am one of these people who does'nt like being trod on at the end of the day you buy there cars you pay there wages.

Also if you have aloan out on the car the company supplying the loan are also responsible in part for the cars well fare I have a friend who was having issues with a car rang the loan company told them he wasnt going to make payments unless his car was sorted ..... they got intouch with the garage and low and behold things got fixed to his satisfaction. HSE TD4 Stornoway Grey ★ Rear Spoiler ★ Black Leather Interior ★ Panoramic Roof ★ Navigation with Bluetooth ★ 19 " Alloys ★ Alpine Stereo 10 Disc Auto changer and Ipod connection and lots of other nice toys ★

I contacted Mike at LR today who told me to set the ball rolling by booking the car in. Rocar Moores reckon that something needs lubricating which they will do with a free diagnostics. TBH the latch makes all the right noises, just doesn't work when in hot sun. I told them about the TSB so will see what happens with my car. From what they said as I have not got a full dealer service then I've no chance of any good will but will see what happens next week. It wouldn't be so bad if the warranty expired years ago but it only turned 3 in may! Big Cry Black MY2013 SD4 GS Auto, Wood Company Armrest, Freel2 sticker.

See how you get on and of course obtain a quote for how much to repair. If the fault only occurs in hot sun then a SOGA argument is going to be more difficult.

You are still covered by SOGA so you have that to fall back on even without a warranty. LL.B (Hons) - University of Derby

Just an update on my situation...
After a chat with a very helpful chap who trades on eBay as partslandrover the required arrived two days later, after spending ten minutes trying to find a stubby screwdriver I set to work replacing the module - it took all of three minutes to do and now the cooling system is fine again. My calculation on the cost of getting this job done by a stealer would have been around £600 - I did it for £60!

The locking issue - this has partly resolved itself as more often than not the door is locking and unlocking but still isn't perfect but it will do until I get the time to visit the stealer...

Once again many thanks for al the advice and support.

Cheers

NSM

Just had my door latch replaced today. Car was two months out of warranty and it hasn't got a full LR dealer service history. I emailed Mike at LR on this forum and LR made a contribution of 33%. Total cost was 150 which was just below what was quoted from my local LR indie. Black MY2013 SD4 GS Auto, Wood Company Armrest, Freel2 sticker.
