Thanks again for the direction, thoughts and comments on the faults.
I am tron to be honest between removing the car (currently on the ramp at LR) to have it shifted to an Indy that could replace a few component parts by the looks of your post, and ultimately stepping outside of the LR Dealership system - somewhat making a mockery of why did we bother to have it serviced by our local LR Dealer consistently for the last four years.

My other view or angle is that on further research, whilst 3 year warranties (in the UK) are all very interesting, but there is a Sale of Goods Act that forms part of the statutory rights and last for 6 years.

The crux point of this is that the SoG act stipulates the goods should not fail unless from wear and tear within 6 years.

As the Transmission is a sealed non serviceable item that is to remain untouched for 10 years or 150,000miles, without any maintenance, component exchanges etc, then for it to fail at 4 years and 51,000miles is to say that it is sub standard.

The SoG act hinges on whether the item is :
"
not of satisfactory quality, or not fit for purpose
"

Clearly it is fit for purpose as it has performed for many in the vehicle - the failure must be due to the quality - of this individual Transmission.

Clearly JLR don't like or agree with this stand point, but I feel strongly enough to pursue it vigorously.

I do find it remarkable that the Transmission is totally non serviceable to JLR workshops - how on earth can a failed solenoid part or similar necessitate a £3200 gearbox exchange ? ?

Comments, advise or criticism of the above is always welcome !

I don't want to make you do something and later regret it... The decisions about your car and the choices of how too service/repair it are entirely yours.
What I've tried to do is to show you the other face of a coin and by no means to convince you to drop the LR service network...
I hope you understand what I mean...

Their decision to entirely change the box relies on the fact that the dealers are not prepared to tackle with the delicate/complicated stuff and they just exchange it and then send the defective unit to the factory, where they have the tools, knowledge and time to do it and examine more thoroughly what happened.
On the other hand, an indy, or a passionate hobbist, will have the time and desire to handle those things because this is the way he gain customers, get renown and get paid.

Andy have you had a chat with team Valley land Rover, they are based in Gateshead, but are great i get them to do all the service work, and they have helped other members out, give them a ring and ask to speak to one of the Graham's Thumbs Up

Thanks all and don't worry - I am fairly pig headed ( ? ) and won't be rashly steered by your comments - in a good way of you know what I mean !

The LR Dealer is going to do a replacement box / exchange - HOWEVER I intend to use all and anything thin I can to seek a full redress by LR on the 'failure' of such a non serviceable item.

Any Sale of Goods Act experts out there?!

I have the same problem as you - same initial issue just before the New Year, now a new gearbox fitted at £3k+ but now some issue with the 4x4 system which may also need replacing at £2k+. It strikes me that we may be able to help each other with LR on this. Could you tell me who you corresponded with at LR?

Have you made any progress on the Sale of Goods Act?

Oh dear - it does sound more frequent than LR will admit to.

To be honest, I have not managed to push it much further since picking the car up - overseas travel Christmas etc has had me side tracked.

I got the goodwill from LR to reduce the bill down to £1,800 in the end and would happily share the emails etc I sent / received.

I can PM the details of who, but a Shelley Panesar was the contact at JLR who 'dealt' with case. THey state the matter is now closed, but I am not satisfied with that.
I have also mentioned the four or five (now six) cases of others imploding but JLR rather stubbornly say that as nothing official has been said internally, that there is no acknowledgement of this being a 'problem' hence covered by anything other than general wear and tear.

Your post has prompted me to do more however and I will now start to campaign a little more and I think that it would not do any harm blogging more / What Car etc
Clearly it is an issue and Trading Standards also agreed that in principle the argument I have is a valid one.
If the Component as a whole (the Gearbox) is not due any form of maintenance for 150k, and fails within half the maintance schedule it is below quality.

As I mentioned in my last email to JLR, the Disco and FR2 I planned to buy in the New Year - will most likely be a XC90 and XC60 now.

Let me know what else I can help with / we can achieve together.

I understand you are back on the road, but have had a wallet bashing ?

current predicament aside, the difference IMHO between the Auto and Spanish box is enough to redefine the car.
When every I get a loan FR2 with Manual it is massively noticeable how the whole driving / waft is.

Andy, I think your link to Honest John was intended to show his reply, but it only opens an email to him??? JT Upgraded to an ex demo, 7 mth old, Rimini Red/Ebony Napoli Auto HSE on 28th Jan 2011, added roof rails, mudflaps and side strips.
Gone - A great 57 Plate, Auto SE, Bought Feb 2009, Roof Rails and Mudflaps added on purchase. Blue colour, anything but drug dealer black.....
