This is a breach of contract. There does not have to be a written contract to be legally binding.

I recently had a disagreement with an ebayseller over something for an iphone costing less than a pound. It was obvious he was selling rubbish and then asking you to return it for a refund knowing the cost to return was greater than the item was worth. I decided not to let it go, and after many mails to him I took it to resolution and also contacted ebay by phone and explained what this seller was doing. He has now left ebay (or asked to leave) either way, its one less scumbag selling rubbish.

I'm afraid it is the way of the world now, no longer can you take a another man's word as his bond, he has more than likely received a better offer, hence they have now gone. As it was done over the phone and not through ebay there is nothing ebay can do, they do advise against dealing out of ebay which is what Superspark has done, and I suspect we have all done similar, but in my mind if I do a deal that's it no changing of minds just for another £1.

Thanks for all your replies guys. I have complained to ebay, dont know what will happen if anything. I think hes using ebay and by not paying through ebay hes avoiding all their fees. Ive noticed that all his items are buy it now or best offer. when you call |

Sorry if i sound unsupportive, as i don't mean to be, but it is possible that someone else has clicked on his ' buy it now ' before he could remove the item's listing. In which case, he is committed to selling the item to that person at the ' Buy it now ' price as they have followed correct ebay procedure . . . . . . . . . |

pedro he had three days to remove it but it only disappeared last night, about 5 minutes after I saw that some one else had made an offer. the wheels were buy it now or best offer, I made an offer but he declined it and left a ebay message saying what he would let them go for and hi phone number to ring if i was still interested.I phoned him stright back and we made an agreement over the phone. I was all set to pick them up on saturday.

You would have had a bit of clout and ebay may have backed you if you had done the Best Offer via ebay and he had accepted it, but out of ebay you are on thinner ice. All flebay can do is a warning for circumventing the fees, but all he has to say is they were damaged or stolen and not sold, who can proove otherwise or had decided not to sell them. Could have beeen worse, look on the bright side, what if he hadn't bothered to let you know they had gone, its a long way Devon to Birmingham to come back empty handed.

This sort of thing is why I use ebay rarely, and with circumspection. Brian

Agreed, I only use ebay with a know shop that I want something from, that way if there is a problem you get a little more comeback than Joe RipoffMerchant Former Mod/Member, with the most post & Chicken George Arch nemesis |
