Pre purchase question regarding servicing and warranty

Hi all,

Long time lurker but first time poster.

We previously had a i6 FL2 and loved it. Traded it in last year and regretted doing so, so looking to get back into an FL2 now.

We're looking to buy an FL2 which a non-franchised dealer is selling. The car was first registered in June 2008 and was first serviced by a LR dealer in June 2009. Car has not been serviced since. Car is now for sale at a non-franchised dealer and they are going to service it before we pick it up.

My worry is it is now 3 months past due it's second service. It still has 9 months of warranty left on the car, so if an issue came up would Land Rover be likely to show us the door because the warranty is void because it's past its service due date?

Car also has 2 previous owners already and it's only 2 years old. My instincts are starting to tell me to walk away from this. Embarassed

Any help appreciated. Thumbs Up

mmmmm Tricky one, 2 owners already, Not been serviced-I'd go with my (in this instance-Your) first instict.
Plenty more good 'uns out there Thumbs Up

Please check with someone with more legal knowledge than myself but my studying of law so far makes me think as follows:

S.14 of the Sale of Goods Act 1979 talks of goods being of satisfactory quality and fit for purpose
S.48A and B talks of the need for repair and Land Rover of course give a 3 year warranty so they will be bound by this Act and these sections.

S.6 (2) of the Unfair Contract Terms Act 1977 states as follows:
As against a person dealing as consumer, liability for breach of the obligations arising from—

(a)[section 13, 14, or 15 of the 1979 Act](sellers’s implied undertakings as to conformity of goods with description or sample, or as to their quality or fitness for a particular purpose);

(b)section 9, 10 or 11 of the 1973 Act (the corresponding things in relation to hire-purchase),

cannot be excluded or restricted by reference to any contract term.

Basically if they point at smallprint that says you have not had the car serviced as we instruct and therefore warranty is void and we will not repair the fault f.o.c, then they are overruled by this Act.

Cheers Junior. I'm going to call LR cust services on Monday morning and see what they say, but good to have some feedback from other owners. Thumbs Up
