I think insurance companies used to work on if it’s more then 2/3 of the trade value to repair they write it off. |

Well if the other car crossed to your side of the road, it’s not your fault. Your insurance will sort it out. You don’t need to do anything about claiming from the other persons insurance. I assume the police attended? I would also have a proper medical checkup on you any passengers. |

I'd say at 10 years old with 113k on the clock it's going yo be a write off unfortunately with panel, suspension and air bag damage.

If the air-bags deployed, on a vehicle of that age, it will not be an economical repair. Sorry.

Yes it seems unfair. On the face of it, as the accident is not your fault, you ought to be able to recover the additional insurance costs that you will suffer for the next 5 years from the person causing your accident. But life's not like that. Jules |

If the air bags have deployed, then the vehicle decelerated fast enough for the body to have been subject to substantial loads. If it were new, it would have been worth a body shop putting it on a jig to check it's still within spec, and tweek it of not. However at 10 years old, with average mileage on the clock, the insurers will say its a write off. However as it wasn't your fault, you have a good case for not being put of pocket at all. Your lucky the other driver has insurance so many out there without any, driving is becoming a risky business no matter how careful you are. 2013 FL2 XS.

On the tv the other day it was it’s 1 in 83 motors are uninsured on the road. |

As expected unfortunately. Now is the time for you to research similar age/spec/mileage cars to provide to the insurance company when they undoubtedly give you a low ball offer. I don't know how it works in the UK but on a write off "offer" by insurance, never take the first or second offer, get them to a third AND, the other driver was at fault so??? |

It depends on the insurance company and policy type, but in a none fault claim, the innocent party can't or at least shouldn't be out of pocket. So if a car is a write off, then the payout should be enough to buy a replacement vehicle of similar age, condition and mileage, plus any out of pocket expenses like bus or train tickets to get to the new vehicle, and anything else the innocent party needs to spend that they wouldn't have needed to if the person hadn't have hit them. Personally I'd ask for a "Buy back" price from the insurance company. If it's less than a grand, I'd buy it back and flog it on Ebay . For the age and mileage, I reckon you'd get around the £2500- £3000 mark despite the damage. It'll make a great breaker for someone.
