Dutch Reach

I hope everyone is on top of their "Dutch Reach" skills. Whistle
As the new legislation starts this next week and is now part of the
Highway code 2022. DAVE.

See it's not technically an offense - you can be fined up to £1,000 IF you injure a cyclist by opening the door on them. Not sure that opening the door with the wrong hand (ie driver with left hand) and still injuring a cyclist will mean that you don't get fined.
Or that you shouldn't be fined irrespective of which hand you use for that matter.

Going to resist the urge to slag off cyclists - just. Tangiers Orange - gone, missing her

It's a bit loose, as IIRC you open the door with the inner hand "IF POSSIBLE"
cyclists are advised to pass parked vehicle doors with at least 1.5 metre gap.

My one concern as how the new ruling will pan out at roundabouts,
Cycles and horse driven will have priority as the most vulnerable,
they are advised to stay in the left hand lane and signal their intentions even when taking a
3rd or 4th exit!
Sadly all motoring groups have already stated the government have not promoted these
new changes enough. DAVE.

The Highway Code is a book of reccommendations, some may be law but not always law, check the wording, unles it says you must, it isn't law, though if it results in an accident you may but not always be charged, it has or was in the Highway Code to give way to pedestrians when turning left, but not a law but a test failure, not so if turning right. Red Tops today tend to over emphasize new proposed legislation as law and quote punitive thousands of pounds fines which don't and may not ever exist my PC is slightly to the right of Genghis

Correct Dartman,
whilst not binding in actual law there is an essence in the code
that does follow legal requirement and to not exercise the guidance
could well result in a claim against one,
Having said that, It'll all depend how good ones legal team is.

The failure of a road user to observe the Code does not necessarily mean that they have been negligent.
Likewise, the fact that a road user has observed the Code does not mean that they cannot have been negligent.
A party may however rely on a failure to observe the Code as "tending to establish or to negative any liability" (s.38(7) of the Road Traffic Act 1988). DAVE.

Well observed.

Although I do make an effort to wait until I can pull out across the road to pass at the required 5 foot gap, most of my more dangerous close encounters with cyclists are in heavy, slow-ish, traffic when they come closer than this, as they weave through the traffic.

Also if they pass at +5 foot (from anyone) then they should not hit anyone alighting from the car., or indeed any pedestrians as they pass on the pavement/shopping centre. FL2 XS SD4 Auto 2010 2012-2017 (21k - 91k miles) (MY2011)

"Also if they pass at +5 foot (from anyone) then they should not hit anyone alighting from the car."

But on narrow roads they might be hit by vehicles coming the other way if they keep well away from parked cars.
Where I cycle there are some villages with long rows of terraces where people park there cars in front, nose to tail. No on-coming vehicle ever waits for me to cycle past the cars they just come on through anyway - probably a 6 foot gap at most between the parked cars and themselves with me in between. They nearly always slow down to reasonable speed though. Jules

Although it is taking your life in your own hands,
if I judge other vehicles are not being driven over zealously,
I would probably cycle further out, away from parked cars just
to emphasise I am there. if you get my drift. Smile

Must admit these days I tend to use the many cycle paths we have around here, Laughing DAVE.

When did they drop the give way to pedestrians when turning left, when I took my test it was one of the three points noted that you could fail on. Seems they are going back a few years, one hopes it is not confused with vehicles turning right as there will be a few deceased pedestrians Whistle my PC is slightly to the right of Genghis

Giving way to pedestrians who are crossing the road, this was never withdrawn,
guideline is if pedestrians are crossing or waiting to cross, **
also if motors are turning LEFT OR RIGHT then drivers are expected to
give way and not cross the cyclist or horse's path.

The one that concerns me is the multi lane roundabouts!
hope I'm wrong but I can see some nasty accidents waiting to happen
as a lot have not been upgraded with lineage or signage, at least not
in my neck of the wood.

** Advice is if your driving and turning left and need to stop,
(assuming one has checked in the turning for hazards)
Then stop/slowdown early and NOT halfway in the turn,
there is a lot of incidences where following motors have been caught out. Rolling Eyes

I feel the Government has let drivers down by not advertising enough,
as these changes have been discussed for at least the last couple of years. DAVE.

This is very good advice.

My ex employer sent us all on a Defensive Driving Course.

We were taught to signal and slow down early, and take control of your surroundings by car positioning. FL2 XS SD4 Auto 2010 2012-2017 (21k - 91k miles) (MY2011)

I wish some people would use the old "mirror-signal-manoeuvre" just for a start or even just "mirror" would be good. Jules
