If I am not mistaken, 40mph (64 km/h) are speeds at which NCAP tests are made. And the cars are getting out pretty "wrinkled".

Ideally no would rather not have car back but Mercedes repairers say car is repairable .

It's a lease car, why worry? if it's not right you return it as not fit, the decision to repair is Mercedes. I very much doubt the actual impact speed was 40 mph unless you were shunted a considerable distance down the road, at 40 mph you should have a roof crease, if not it wasn't 40. my PC is slightly to the right of Genghis
