For the sake of a couple of phone calls, and getting the car back to them to at least check it over mate it will be worth it in the end as you will then know for sure one way or the other

at least the dealer is willing to take it back to inspect, although I bet they didn't like it when you quoted the consumer rights act Very Happy

it may well be that they were genuinely unaware of any issues, however the consumer is better protected than ever before now even if you do have to escalate it a bit and they should take more care in the cars they sell.

In defence of the supplying dealer I doubt that had any idea that there may be a large issue just waiting to raise it's ugly head, although there is the possibility that the person who traded it in was aware. The car came with a fully stamped service book so from a trade in point of view that is all they can go on and not being a Land Rover garage, wouldn't have the skills or diagnostics to check prior to taking it on.

From my side, I'm happy the dealer is going to take a look, it's a shame that I had to quote the act just to get a response but at least now the ball is rolling. I will now need to check that they don't just top up the transmission fluid and hand it back

Had something similier in my Renault, in the end it was sensors and solenoids issue, was still expensive to fix but not like changing the all gearbox

An update and some advice from you knowledgeable guys please,

After having the vehicle for 2 weeks the garage have just called to say that they have taken it to an auto transmission specialist who have reported back that the gearbox needs replacing, nothing new there as I already had this as a diagnosis. They were asking if I had any warranty with the vehicle when I bought it from them to which I replied yes, what I didn't say was that the warranty was the basic bronze package which wouldn't cover the cost of the repair (now at £2,500)

I mentioned to the service guy that the car was purchased around 4 months ago and that according to the consumer rights act 2015 they are liable for the repair as it is deemed that the fault was there at the time of the purchase. If as I suspect the warranty doesn't cover the repair cost, can the garage make me pay for the repair cost. I've had a look at the act concerning used car sales but cannot find anything that confirms either way

OK so garage called me on the way home to say that they would offer £1,000 to the cost of the repair as the warranty would not cover the cost, leaving me to find the remaining £1,498

I told them that as far as I am concerned they are liable for the full cost of the repair, so now I have to write an e-mail to the dealership manager explaining this, you would think that he would contact me out of courtesy. I can see that this is going to be a long argument before any resolution is reached, in the meantime I am out of pocket having to hire cars just to get to work as they never seem to have any courtesy cars available.

You'd be a fool to pay anything towards it. Could you not threaten them with rejecting the car completely and going for a full refund? Do you have any legal cover insurance, perhaps with your car or home insurance? It sometimes comes bundled with some bank accounts.

The dealer won't like it and will no doubt try to wriggle out of it but if something major goes wrong that soon after purchasing it, it should be down to them. That's tough luck on them - all part and parcel of being a car dealer. Past: FL2 TD4 HSE Auto

Good point regarding legal cover I do have this on my car insurance so may come in handy. There is no way I'm going to pay anything for the repair and I can this being a bone of contention which will drag this whole process out.

From honest John website :

After 30 days and up to six months after purchase, the dealer has one chance to provide a free repair before the buyer is entitled to reject the car for a refund, though in this timeframe it may not be for the full sale price.

Gives me clear indication that I should not be paying for the repair, thanks for the heads up Thumbs Up

Resolved

After 4 weeks my Freelander is back with me, it took a few phone calls and e-mails before the supplying dealer agreed to cover the full cost of the repair. They sent it to an automatic gearbox specialist who rebuilt the gearbox and it now changes up and down the gears nice and smoothly.

A special thanks goes to RogB for pointing me in the right direction of following the consumer rights act, had it not been for this I would have blindly gone and paid for all the repairs myself.
