I dealt with them directly after getting nowhere with the dealers, mainly over the phone and then put in writing via email. The guy who sorted things out for me was brilliant and I can't thank him enough. giving us the confidence to by the second FL2 this month. If anyone want's his contact details pm me.

Not much point them being on here is there? Unless they just like to see what we're saying about them.... Laughing

I think they've stalled you until you are past the 30 day limit. Knock off the days it has spent in their workshop and you could reasonably argue that you haven't had it for the full 30 days. If you seriously want to return it, email them TONIGHT and state that in writing. Past: FL2 TD4 HSE Auto

I don't envy you the hassle but would give it everything to reject the car.

Time spent requesting repairs or having them carried out is not to be counted so as far as the law is concerned, you haven't had it 30 days.

Just be wary that the value of the refund you are seeking will exceed the small claims court limit so you will be open to legal fees if you lost any court action. Even if it was in the limits, the dealers usually win because customers do not want to cease using their car due to the inconvenience and they do not want the hassle of pursuing it.

I advised someone on another forum who did pursue it (although I highlighted weaknesses in the case) and he entered into a negotiation with a mediator before the court hearing and emerged victorious. He just agreed to a small deduction on the refund in order to settle out of court. LL.B (Hons) - University of Derby
