Took me a while to work out what exactly was going on until I worked out it was on its side!

Why is it not a police matter as it says in the report? Driving without due care and attention? 2016 BMW X3 30d SE in red

The story is a bit vague as we don't know what caused the accident, it also looks more like a RR Sport to me. As for the police, I suspect they conducted preliminary enquiries but concluded it was a simple enough accident and left it to the recovery vehicles and the insurance companies. It is possible albeit unlikely, that they didn't even attend or were not called to the scene. The council workers will have cleared up the mess.

I rang the police in 2006 after I had been in an accident (no other cars) after a blow out and the operator asked if I really needed the police, just get a recovery vehicle etc. I added that I had taken out half a tree and there was bits of car everywhere and so they deployed officers. LL.B (Hons) - University of Derby

Cannot believe there saying it's not a police matter and that the police are not perusing this, clearly driving without due care and attention or reckless driving, or even a bit of showing off to her mates. Where they breath tested ? What if there where pedestrians walking round that corner, or a cyclist on there way to work, it would be a different story then even tho it was 5am

Think it would be different up here in the north

Why is it "clearly driving without due care and attention or reckless driving..."? I am not saying your theory is definitely wrong but based solely on the story in the link, there is no real information as to what caused it to happen.

As I posted above, preliminary enquiries may well have painted a clear enough picture for the police. The lack of other vehicles involved or pedestrians injured is a key aspect.

For all we know, a dog may have ran out and she swerved to avoid it. Or a pedestrian stepped out and she swerved. Perhaps there was a blow out if she ran over something sharp (unlikely though). Brake failure (again unlikely). The list could go on and could include reckless driving but there must, in all probability, be some factor not stated in the papers to make the Met arrive at that conclusion. Any suspicions of unprofessional work by the Met could easily be brought to the attention of their PSD or the IPCC if anyone wished to complain.

There's a lot of 'what if's' in this thread, as far as i know the police do not prosecute for a 'what if', so we must assume their decision is based on facts, of which we are not privvy to.

Hi doc I guess we might never know unless it's been caught on some cctv, it's just I have driven one of these and I chucked it around a bit and it stuck to the road as good as most motors I driven. My other thought maybe at 5am some damp or ice but there is some pretty clear rubber marks on the pathment. I will take back the clearly bit, as like you said there are unknown circumstances.

I'm pretty sure it it was found in Liverpool the police would be knocking on the owners door with a breath tester or am I assuming to much here in today's society. Just thinking back 30 years my car was outside my flat and the police knocked on my door and came in and searched my flat for drugs and all they had to go on was a small towel covering part of my number plate that must of fell out my kit bag when I took it out the boot they obviously thought I had been up to no good, when I had only been out to karate training. But they still came though my door and I hadn't even crashed my car Rolling Eyes

There has been a huge change to policing with the Police and Criminal Evidence Act and the Regulation of Investigatory Powers Act. In the accident I mentioned where I called the police, they performed a breath test on me.

On Top Gear several years ago, the police showed the team how to execute the 'T-PAC' on a moving car. Clarkson mentioned that they need to fulfill about 16 health and safety criteria before they can do it. So Clarkson suggested pulling alongside, winding down the window and blowing his head off! Why is there suggestion of plod wrong doing, when as has been pointed out we don't know all the facts ?

The police have no power to breath test unless 1) they suspect you have been drinking (unsteady, slurred speech etc) or there has been an injury crash. The injury must be to someone other than the driver. In this case there is no injury to anyone, and in fact nothing to suggest this is an accident as defined by the road traffic act.

Definition is injury caused to any person (other than driver) or damage caused to another vehicle or anything growing on adjacent land (tree on verge) roadside furniture (bollards, lamp post etc) Private railings around a property unlikely to count. Injury or death to certain animals (Cattle, horse, ass, mule, pig, sheep, dog & goat) All included for historic reasons as animals used to support a living.

You can buy a Range rover, smash it to pieces and not break the law or commit any offences.

So - No injury, no accident as defined by law, and no police left due to massive cuts. Don't get me wrong, I will be the first to moan about incompetent police when it is properly evidenced, but until then give them a break.

I guess as a teenager in Liverpool even tho I have worked all my life from a few days after leaving school I have been harassed and stop and searched more than most in my ford Capri Cool driving round Liverpool, for what seemed to me No Reason. So I've seen police in a different light I guess, Don't live there now, lucky if a see a police car twice a week in our town.

I too was given grief as a 'yoof', (deservedly) but not now been stopped for 25 years since I was given 3 points for speeding. The police have the power to stop any vehicle on the road. They need no suspicion or belief, just the fact you are driving on a road is enough. They can then through interaction form grounds to search, breath test or seize the car.

There are always a few knobs (they are recruited from the community !) but generally they do a bloody good job.

Just for the record I don't doubt the police do a good job and like you aero I've not been stopped in a very long time, but if your all legal, have nothing to hide and drive sensibly I guess you got nothing to worry about. As I tell my 21 year old lad with his Subaru WRX.
