I though the police gathered evidence
The Crown prosecution service decided if there was enough evidence to get (warrant?) a conviction.
In major cases a jury decided guilt and an experienced judge decided the penalty.
In minor cases a judge was also the jury.

Now for the sake of expedience the police are also the prosecution service, judge and jury.

Sounds like rough justice, without the justice.

Slightly jaded view of our police as we have just had another run in with a power crazed officer, who completely changed her tune once she realised she was being filmed, and was warned that should she continue to insist that we had a legal obligation to do as she wanted, that the matter would be reported to the IPCC.

Don't get me wrong it's a Censored job, I wouldn't want to do it, and some are doing thier best, despite being in the front line and being stabbed in the back by superiors insisting on artificial targets being met.


Lets be serious, we all would like tailgaters, and middle lane muppets penalised, lets do it properly, with evidence that will stand up to independant scrutiny. Tangiers Orange - gone, missing her

But no one has answered the question of what is tailgating. I have not seen it defined. I somewhat regularly drive a 3.5 tonne motorhome so normally leave a reasonable gap to the car in front. There are a few times when I don't the most frequent being when some else decides that the gap is big enough for them to squeeze into then apply the brakes which are usually better than mine (the most frequent being when 2 lanes reduce to 1 at 60 mph) they then seem to get upset that I am too close to them. The other is when I want to overtake on say a motorway and due to slow acceleration I need to watch for a gap the accelerate into it so I close the gap to the vehicle I am passing before pulling out - if I don't do this I slow others up in the lane as they catch me up. Am I considered to be tailgating at those times? Silver 2009 HSE

I applaud what is to be done, it is high time people started to concentrate a little more on the road and drive as the rules demand, this includes the idiots who slow down or even stop on a busy highway to let a car pull out, keep going FFS, if someone on the inside lane indicates to pull out, do not slow down to let them out, you have right of way they should wait for a suitable break.
As for tailgating, maybe the plethora of chevrons on the road will offer a clue, the good old two second rule.

One problem with middle lane hogging I have found, is that we have many drivers from other countries where staying in lane is the norm and passing both sides is allowed, there is no excuse for not knowing the rules of the road in the country you are driving in, it's simply lazy if you do not know them.

As for mobile phones, I don't think £100 is enough, make it higher and confiscate the phone on the spot for me.

I don't tailgate, but I know that when I leave sufficient space inevitably a car squeezes in. Suddenly there is no longer a big enough gap. Am I tailgating then? Well it only takes a few people to get caught out like this and it will be brake lights all the way down the motorway every few seconds ... Which also causes accidents.

If enforced fairly to catch out real tailgaters - that's great. Lets see how it goes. As I mentioned previously, clear guidelines of what tailgating is and make sure there is sufficient evidence (video footage of sustained driving too close if that is the definition).

And please dont lecture me on finding excuses for fines and points accumulated in the past. Because there hasn't been any!

As for mobile phone usage. Clear cut. Simple right and wrong. Enforce away. Confiscating the phone will be an effective deterrent, especially with a fine and points. (Coming) 2016 RR Evoque td4 180 HSE Dynamc

My method of getting rid of tailgater's especially if it is a van or truck, is to just lift off the gas and let the speed drop off 10mph or so and then accelerate again, if they tailgate you again, repeat the exercise as necessary and they soon get the lesson.
