Parking tickets

Some dirty bullying Nazi has issued me with a parking ticket...in the car park designated for my flat. Censored

I have a designated space (fair enough, would always be their for me to use when I want it) complete with mirror-hanger stating my entitlement but this is at the top of a multi-storey that has ramps so severe my car cannot get up (Golf GTI, the front splitter touches the ramp, a long way before the wheels) Rolling Eyes

I left a note explaining this in my car, and parked in a 'Visitor/Disabled' spot, as every other space is numbered and designated. Furthermore, the disabled/visitor space, which I know not to be designated to someone, is not allowed to be used as it has a number also, meaning that even if someone was a visitor/disabled, they would be issued with a ticket for not complying with showing that you are the designated owner of the space.

Furthermore...the management company last week told me that they were delaying the introduction of the enforcement as they have had such a backlash (previously 4 years of none enforcement has led to no problems whatsoever).

So what do I do here? The ticket's still on the car as I would assume that they can't issue the same ticket for the same offence...? Mine: 2012 Golf GTI Edition 35

Invoice, it's a private company

The ticket is actually for 'trespassing', with the 'disabled, no badge' being a secondary reason. Mine: 2012 Golf GTI Edition 35

Ensure they have been engaged by the Management company first.... theres been a lot of random companies trying on land they have no right too.... in fact its a driving reason for recent changes in the law.

If its a penalty charge notice it is a fine, if it is a parking charge notice or other wording it is an invoice.
They will have to take the driver to court to get their money and you are not obliged to tell them who the driver was, simply don't pay it, they will hound you for a while with threats etc then give up as they have no evidence of who committed the crime. How many people pay the money on supermarket car parks, hospital car parks etc, all without needing too.

It's all kosha as far as they're concerned. The management have given them permission to be here.

It is the 'Parking' type notice. The problem is if a judge comes down on their side (if they take it that far) then I'm royally screwed! On the advice of a solicitor though the car's back in the space that a rep of the developer originally told me to use...this'll go down well with the company who now think they own it on Monday morning...! Mine: 2012 Golf GTI Edition 35

They won't risk court, there is no offence committed, they could only go after the cost of the original "fine" which is nothing more than an invoice sent to someone who they have no contact with, it's as much use as me sending you an invoice for moderating posts on here, you wouldn't pay that ..........would you? Don't pay it, I received 5 different tickets from motorways services and not paid a single one. Nothing heard from any of them. It's been over 2 months now.

Cheers Taz, have been looking through that.

The management company have told us, they also told us they were delaying the implementation of the ticketers last week...bastards.

ANPR cameras do make mistakes, on the Services, if you closely follow a truck in, the APNR cannot detect your reg no, nor can it when you leave, there is a story doing the rounds in our local rag about a car park where a guy has gone into a car park and the APNR camera detected him but didn't clock him leaving an hour later, a few hours later he has returned to the car park and again the APNR didn't detect him, but it did detect him leaving so they have billed him for eight hours.

ANPR cameras record the driver going into and out of parking zones, they do not record the actual offence of parking for too long.
As my brother told me, he would have loved it to go to court and defend me, the cameras clearly showed me behind the wheel, driving onto and off Lymm services three hours later, two hours is the maximum.
The actual offence of being parked was not recorded, they therefore could not prove whether I had actually parked or simply driven round for three hours Laughing
I received 4 letters in total threatening court action, bailiffs and credit rating disruption, in the end they simply gave up.

That sounds very convenient AD, even more so on some of the cases I've heard about whilst reading up last night.

The company is actually called ANPR though, it's not they camera's they use.

Haven't denied I've parked. Because its a private ticket they have to demand 'compensation'.

All court cases surrounding this show that I haven't dont anything to the ticketing company for them to demand compensation, and my actions haven't caused damage or loss to the management company.

This is why the advice is not to pay up if given a parking ticket! Mine: 2012 Golf GTI Edition 35
