Roof Mounted Driving Lights And The Law

All,
Question regarding roof mounted driving lights.
The Road Vehicle Lighting Regulations 1989 (updated in 2005) does not appear to give any definition or dimensions on the mounting of Driving lights in the same way that it does for Fog lights.
However there are a number of posts on various internet forums stating that the use of roof mounted lights is illegal on the public highway (including Green Lanes) because they are over the height limit of 1.2 metres and located rear of the front axle (even if wired through the main beam circuit).
Does anyone know where, or if this is ‘written down’ in road traffic law?

If it is illegal to have them mounted that high a lot of Trucks I see are illegal, many have bars across the tops of the cabs, one make in particular comes from the factory with Headlight type lights fitted to the top corners of the cab.

No they aren't illegal.
The Roads Vehicle Lighting Regulations 1989 do not refer to driving lights or spotlights for that matter. No such things in law.
Auxillary lights are refered to as "Optional Main Beam Headlights" which are not subject to any height stipulation. Schedule 5, Part 2.
You can therefore mount "optional main beam headlights" anywhere from below the bumper to above the roof and they will be road legal.
The only stipulations in the Regulations are that the Lights must be E marked, they must emit white or yellow light, and they must dip or turn off when the obligatory headlights dip.

Thanks for the replies. That's the way I read the lighting regulations.
I need to modify the roof carrier I made for my old FL1 and make it a little wider to suite the FL2s slightly wider body and then wire the lights in.
I will post some pics when completed. Very Happy

Yes, thought about the X-Trail so took a look on a Nissan forum. Apparently Nissan state in the handbook that they are for off road use. I still agree with Nicedayforit with ref to the Lighting Regs.
