Using tailgate release on remote sets off alarm - sometimes

I lock the FL2 with either one or two pushes on the remote control.
If I then press the tailgate release on the remote control all is fine, I can open the tailgate without the alarm sounding and the rest of the car is secure. Closing the tailgate secures the tailgate with a confirmation one or two flashes on the indicators. HOWEVER if I leave it about three hours or more after setting the alarm when I press the tailgate release on the remote control and then open the tailgate the alarm will sometimes sound. I know if the alarm is going to sound as the indicators flash once on pressing the tailgate remote button.
I have this intermittent fault and it makes no difference which remote control unit I use.

Has anyone out there had this scenario and or knows the solution?

My dealer cannot find a fault and states having never comes across this before.
