The contract of insurance absolutely allows the insurers to declare a car uneconomical for repair and write it off. That's the basis of the contract. You can, of course, appeal. But to do so you will need evidence that they are incorrect in their assessment, and passionate statements regarding ownership of the vehicle will count for tuppence in the eyes of the insurer or the ombudsman when weighed against contract and engineers reports.

What folk sometimes consider is accepting a reduced payout and buying the salvage back to repair themselves. Now with utmost respect to the OP, with the damage described on an 07 plate you would have to be off your head to consider going that route.

Source: I was previously Head of Complaints for one of the largest insurers in the UK and now run a Consultancy Firm working with the FCA, the Financial Ombudsman and more insurers, lenders and car manufacturers than most people have even heard of.


If you're claiming against your own insurance, then you're spot on, your insurers can deem the vehicle a write off on financial grounds.

However in this case, it was the other party totally at fault, and admitted it.
So his insurance MUST pay for a perfect repair, or an EXACT replacement, if the vehicle can't be repaired due to structural damage, making a repair unsafe.
The insurers of the person responsible doesn't have any choice in this, as in law, the third party can't be out of pocket in any way, the insurance rules and the law are very clear on this.


I agree I think I am fairly solid ground as to getting a decent payout. As I say time will tell. Have the hire car now arranged. Is available for up to 48 weeks, somebody sounds pessimistic about an early settlement.

Hi,

collect evidence for cars of the same spec, miles, age and get a price from wbac just to see what is a fair price and IF you want reject their first offer,
ISTR that when they offer/you accept an insurance payout thats when the hire car goes back Shocked
as its then the end of the insurance contract as they have paid you.

best of luck sorting it you may not be financial out of pocket but your time and stress thats another thing Sad

Still waiting for hire vehicle. Was told I can have an estate or a 4x4, neither turned up got a Mercedes E class saloon, nice car but totally unsuitable. Supposedly getting a transit van tomorrow. I will believe it when I see it. My insureres were useless in organising a hire vehicle had to go via 3rd party insurers.

Now a question someone may be able to answer. The insurance was/is due to expire end of June. Do I get any credit for remaining months? or do I assume they will included that in their offer?

I will never understand this insurance lark. Fault 100% not mine yet I will face an increased premium even though I have a protected NCB, something does not seem right with that.

shop around for insurance every year,benefit from new customer discount,even with a claim i got a great deal with lloyds.

I had my now gone Freelander insured with Lloyds once , best price I could get . After 12 months the price went up . I then insured it through my late wife’s Halifax account and got a brilliant price . Both Lloyds banking group , same underwriter , figure that one out , I couldn’t ! 2009 GS Auto Zermatt Silver - Sold June 21 after 10 years of ownership

Insurance just continues on till the end of policy unless you cancel it or use it on your new vehicle. I believe your insurance is used on the hire car whilst you use it.

When our Evoque was finally written off we had a grace period to find another car then changed the existing policy over to the new car and we had a small policy refund as new car was less to insure. We did have nine months left though so wasn’t worth the cancellation charges to change insurer.

Your insurance will definitely rise slightly at renewal unfortunately even though you are not at fault. You are seen as a higher risk and will have to declare it for 5 years.

My unfortunate wife has to declare two accidents (both were not her fault in any way) and pays an inflated premium even with full no claims. Insurance co’s will always get everything they can out of you!

Tell me lol. The hire car insurance was paid for by the 3rd parties insurer. My Policy was cancelled as oo n as they declared her a write off. She went through Copart this week.

There is no such thing as new customer discount anymore, new legislation has deemed it illegal to charge new customers less than existing customers. Regards
