Scratched again

Went out to my car earlier and have had it keyed again, on the boot door section which is right of the number plate. Evil or Very Mad

The same thing happened last Saturday night, but was quite faint and would have polished out, thought that might have been a accident or maybe done whilst drying the car as i had just washed it (but knew i wouldn't have done that), but this time it is down to the paint through the lacquer. Big Cry

The rear end of the car is just off the pavement on my drive, so could easily have been somebody walking past

I think it must be the same person (i don't know who), on there way home from the pub for it to be in the same place. Whoever, he/she is a c**k.

Can you record via CCTV/webcam/camcorder my front garden, driveway and public pavement without breaking any stupid laws Question

If so whats the best option for me to do this Question

I have seen a PIR flood lamp that has a CCTV camera built in (£99), but this would be forever lighting up the front garden/recording as well with people walking/driving past the house. This would be ideal for the garage looking down the drive (covering the house door) but not the area my cars parked. Former Mod/Member, with the most post & Chicken George Arch nemesis

You can install CCTV in your own property without any problems with regards privacy laws. Only thing is if you want to get a good enough picture for Police & Prosecutions you will need a good quality system, unfortunate thing is if the little begger is wearing a hat or the like you won't get a good enough picture of his / her face.

Hope it doesn't happen again.

I seem to recall one of the forum member been in the CCTV industry or knows a little about it, can any remember their name, or can you contact me Very Happy

Looking at this setup on ebay for £250, 320gb HD RECORDER, 4 x IR cameras, wouldn't mind some feedback on it Embarassed

Somebody scratch my car again, whilst parked on my driveway Evil or Very Mad I know they won't stop it, but at least i could see who did it and maybe get somewhere if it happens again. My worry with the security light linked to CCTV would be if the little scrote is a knob enough to scratch your car the light might incite it to do more damage.

Sod the CCTV, cops etc. Sit up tonight, watch out for the offender, follow it home at a safe distance, then exact your revenge with either a retaliatory act or maybe a van load of mates and some snooker balls in socks....

Might be the advice someone would give....not me though...oh no..... Whistle

Also I'm not sure where you would stand legally with the courts accepting that this can be used in evidence, even if you did get a full face, recognisable image of the ned.
Doesn't a police officer have to verify it or be there at the time or something?

CCTV & The Law:

If you're a CCTV user that has installed a system in your business premises then the Data Protection Act 1998, CCTV Code Of Practice will apply to you and this must be upheld and followed. However, the Code of Practice does state:

"Security equipment installed in home by individuals for home security purposes."
- Part 4 of the Data Protection Act 1998 covers Domestic Use:

Domestic purposes: (36) "Personal data processed by an individual only for the purposes of that individual's personal, family or household affairs (including recreational purposes) are exempt from the data protection principles and the provisions of Parts II and III".
So you or your neighbour using domestic CCTV may not be directly affected by the CCTV Code Of Practice, but read on for more information in Part II.

Human Rights?

It is possible that CCTV usage could well be viewed as a possible infringement/invasion of your Human Rights under the Human Rights Act 1998.

So what do you do if your Neighbour is pointing their CCTV at you?

The Human Rights Act of 1998 could assist you and we would advise you to fully investigate this with a solicitor who has expert specialist knowledge in this area.

e.g: "Article 8: The Right to Respect for Private and Family Life, Home and Correspondence" could well infringe on your privacy by your neighbour


I would advise that you talk to a solicitor Nick, just to be on the safe side with this suing culture that we now live in.

Cheers for finding that Dave, the camera are going to be looking at my property, not towards any neighbours bathroom windows or anything like that, the only one that will catch public images is the one located towards the front, as it will have the road/pavement and neighbours driveway slightly, which i would speak to him on anyway Smile

I do have a garage, but as you see in the photos below the driveway narrows down the side of the house, just past the gates.

With having 2 cars, we normally just park at the top of the drive, just before the house and gate, so my son can play on the gated drive, or back garden. We will be starting to drop the wifes car past the gates, and mine right down behind it, If i go down further, the door has to touch the wall to get out, so i might aswell risk the occasional keying Confused . That and since the garage was broken in too, i have a metal shed within my garage as a lockup for all my more expensive tools and car polishing stuff. So i don't have enough room to get a car in there

I might alter the rockery in the front garden to a drive extension lay bye type area, but i would have to place foundations and build it up to follow the drive, where the wife could pull her car into and mine then right down to the gate

To the best of my knowledge the Human Rights Act 1998 only relates to public bodies; as a private citizen seeking to protect his property I would think you're safe. It's probably wise to speak to your neighbours (as you've said) to reassure them that you're not spying on the them or commiting any voyeurism offences-Sexual Offences Act 2003.

that picture is when i was cleaning the car last year showing roughly where is park it

The car (inc towbar) is about 1 -2 feet off the pavement, but still within arms reach or there abouts

Personally i think its either a P!55 head on his way home from the pub, a Bobble hat greenie or some scroat who thinks it funny to scratch a car that they have seen somebody taking their time to wash and polish to impress his girder gob girlfriend in a vain hope of a sticky fumble in the woods further up the lane

Then chain him to the towbar and take him home

I'm pretty sure that if you install a CCTV system for the purposes of security (which in this case it is) and that system looks out onto a public place then you need to have a sign up saying that the area is covered by CCTV for said purpose. I'm pretty sure there are no rules on where the sign has to be other than it must be seen before and in the zone that the system covers. So essentially you could have a 2 inch sign in a corner of the front window of your house and be good.

Now I'm going from what I was taught on an MOD CCTV course so the rules may well be different for private users - although the acts that govern privacy are essentially the same.

I've heard of people filming chavs throwing stones at their homes and sucessfully used the footage to prosecute said chavs. Well.. at least give them one of their prized ASBOs.. Confused Sad

Indeed if you want to take someone to court over what culminates as criminal damage, the evidence you provide will have to be of a quality that can be recognisable in a court. However, you technically don't need corroboration to prosecute if all you have is a tape of them doing it. The only crimes which need corroboration by law being high treason, perjury and beleive it or not, speeding! 09MY FL2 Td4 XS, Style Pack, Privacy Glass, Martinique Blue.. oh so very blue..
