Car broken down again. Can I reject the car?

Evening

Had the car from new for 8 weeks and 2000mile in to its life.

It's has failed on us twice in this time, all started with a squeaky clutch pedal. Went to collect it today after being with LR for two weeks after having investigation work, a new clutch and a bit of a polish to remove scratches that were there when we collected. Didn't even make it out of the dealer and the clutch yet again failed. Pedal was flat on the floor and needed manually lifting

Now, what are my options. I love the car, colour extras etc but after having issues with a previous FL2 Manual, Im hinking I should have gone for a auto. Can I reject the car? Refund? Expect replacement? Or do I have to keep the car.

Would say you have a good case to return it under the sales of goods act, in that it fit for purpose, of good quality and as described.

It does say you should return it within a reasonable time 3-4 weeks but a new vehicle should last more than 2000 miles or 8 weeks even if it is a Landrover Thumbs Up

Disagree, you've got to give them a reasonable chance to fix it. From what you describe, whilst annoying, it's absolutely nothing you'd get away with returning the car for IMHO.

A lot depends on the goodwill of the dealership,
Many years ago, I ad a brand new Montego estate (remember them) well for a couple of months and many miles, there was an issue with the balancing, numerous (paid for ) re-balances at different locations, even on car balance (very expensive at the time) resulted in the diagnosis that the tyres were not true.
trip back to dealership who said the problem and any claim was with Dunlop, I stated that as they had supplied the car with the dunlops they were my point of contact and therefore any subsequent claim was between them and Dunlop, this now being 5-30 pm on a Friday evening, the sales manager smuggly stated that they had no tyres and no means of fitting them!
I looked around the showroom which had 4 unregistered Montegos and said I would, to move things along take 4 new wheels from one of the new cars, ---don't think he could believe my cheek and eventually agreed, Smuggly, I watched the sales team on their knees taking off new wheels and tyres and putting them on my car- followed it up and yes, not one of the tyres as supplied new on my car were true and it was a manufacturing fault. dealt with that dealership for the lifetime of the car and bought the replacement from them when the time came.
see what you can arrange and discuss with the sales manager.

That's what i was thinking. I'm just so annoyed with the dealer seemingly incompetent mechanics. I even had to tell them why I thought the cruise was disengaging along with the shift indicator.

Going to pop and see them this morning and see what they are prepared to do..

I would agree that they should be given chance to fix it. Worth noting that time taken requesting repairs or having them carried out is not to be counted when deciding if enough time has passed to show that the customer has accepted the goods. If enough time is deemed to have passed, a rejection argument would fail.

Also worth noting that the small claims court is limited to £10k value. Above that and a court battle (the dealer would fight you), could leave you liable to big costs if you lose. Not so in the small claims court.

Best bet here is to approach the dealer principal in writing and say you are not happy etc and would like to exchange the car for another one or an auto. Request that due to the unsatisfactory performance of the car so far and the inconvenience caused, you would like full price on the existing car. LL.B (Hons) - University of Derby

When the new BMW Mini came out in 2001 I bought one and started using it as a Driving School vehicle , it proved very popular with the youngsters , the gearbox failed about 5000mls and was quickly replaced under warranty .
Main issue I had was water ingress from around the windscreen resulting in puddles on the dash , went in 3/4 times and they said they had sorted it but when the rains came back end of summer it leaked again .

The car was in the dealers a total of 10 days over a period of months and I started to lose confidence so I drafted a letter to DP listing the probs and days lost due to the vehicle not being available (in the early days it was difficult to get a dual controlled BMW Mini as a stand in replacement) and said I wasn't happy and asked that the vehicle be rejected .

I didn't hear anything for about 3 weeks so I rang the salesman who sold it to me , he rang me back next day and said BMW had offered to take it back and I could order a new one at a cost to me of £500 , by now my car had done about 18000mls so I accepted this and got the new Mini a few weeks later .

Don't get me going on Morris Marinas (nostalgia) I learned so much about cars by owning one of them. I spent every weekend working on some problem or other (even the exterior door handles used to snap off). I didn't do the advanced course and get an Allegro though.

Wish I hadn't mentioned the Montego now, twas just an example that with persistence you can get results, mind you, for it's time it had leccy windows and a sunroof!!!!!!!!! and was an ok type of car (honest) Whistle Hit it he said, Hit it!--So I hit it, then he hit me---Doh!

Well, after a meeting this evening with the dealer, they have agreed to replace the car with a bend new one and possibly upgrade as a good will gesture, if they can find what we want in Land Rovers new stock. They are calling tomorrow with the cars they have found.

I'lol update you tomorrow with the outcome.
