Hence the expression "The law is an Ass". It is only concerned with the narrow legal interpretation of the law, not it's consequences or logic. My understanding is that it only applies when overtime is compulsory - voluntary overtime would not be used. I also believe that it will not be back dated.

If I am correct then surely someone working compulsory overtime 52 weeks of the year should be paid the equivalent wage when taking a holiday.

Whilst we all sit behind our screens owning c £30 grand motors there are tens of thousands working in sweat shop conditions - and more shockingly hundreds/thousands of employers happy to let them. MY 09 GS manual in Lago Grey, Wood Co arm rest and side bumper strips - now sold.

When is overtime compulsory?

Years ago I worked as a service engineer, contract said "overtime will be worked as and when the Job requires it". The working time directive was brought in, and the only engineer who did not sign it was forced to leave weeks later.
I kid you not, but received an official warning for being 30 mins late for work, after working a 23 hour shift. Back to back 24 hour shifts were not uncommon - my longest was 3 & 1/2 days strait, just sleeping during lunch/tea breaks.

It was cheaper to employ 4 guys working 12 hour days (6/7 days a week), rather than 6 guys, with 6 vans, 6 holiday entitlements, 6 people to go off sick. Pay them all a fixed hourly rate and you can work them all night.
The system falls down if one does actually want a weeks holiday, then the 3 remaining guys have to work 16 hour days.
Would have been nice to get average overtime in that job.

Before you think it was a small backstreet outfit, there were over 400 employees.

I for one strongly believe that all overtime should be averaged out and included in holiday pay.
Backdating it without warning would be unfair to employers, but if they were given fair warning, and then some manage to drag it through the courts for a few years because it's cheaper than actually paying the employees, then by all means back-date it to the time of the first court case. Tangiers Orange - gone, missing her

Well I am retired and I don't get time off, holiday pay or overtime from my pension provider and I can't even resign. Still it's steady I suppose. Sad

My first job was in the Civil Service. Back then in days of yore there were two classes of employment, established and unestablished. Being established meant that the job was pensionable and you were virtually impossible to dismiss.
