Obstructing a road

Just read this local news article about a fella who parked on a country lane and the police towed him away for obstructing the road

The fella is a bit unlucky but is there a legal minimum for leaving clearance on a road? I would imagine its a common sence approach for the emergency services really? Black MY2013 SD4 GS Auto, Wood Company Armrest, Freel2 sticker.

From the Highways Act

137 Penalty for wilful obstruction.(1)If a person, without lawful authority or excuse, in any way wilfully obstructs the free passage along a highway he is guilty of an offence and liable to a fine not exceeding [F1level 3 on the standard scale].


I imagine the 'free passage' to be the key factor? that covers all events across a range of road widths.

serve him right - daft sod. just because there are no yellow lines doesn't mean its a good place to park, he'd be high on the list of moaners if the council did paint every possible patch of road yellow At work
