United Kingdom 2013 Freelander 2 TD4 HSE Auto Orkney Grey
Repairs

I recently had a minor accident and slid into a dry stone wall. Damage was to the two passenger doors. Embarassed The repair garage had to replace both doors due there being previous damage to the doors. This increased the cost of repair.
I bought the Freelander with 2000 miles on the clock, it was 5 months old, and sold to me 'accident free' from a Land Rover Dealership, having had one previous owner.
I contacted the dealership, explained the situation, they listened and said they would get back. They have not.
I have had the vehicle under one year.

If you can prove the dealer sold it as accident free in writing, get a statement from your repairers that it had a previous accident and I recon you have got a strong case of misrepresentation and trade description. Without documentation then sorry but I think you will just have to bite the bullet.

Lack of knowledge actually doesn't stand up in a court of law, its up to the seller to prove that they made every effort to ascertain the details they gave out were correct. If they were unsure then they shouldn't have advertised it as accident free. if they have on their advert something like "we believe the details to be correct" then that is their get out

This is often done with the mileometer for example, you may find a sticker over it or mileage believed to be correct.

yep if the previous owner didn't tell the dealer the truth when asked if there was any accident damaged then its hard to prove,
and usually the dealer only is interested in serious damage if the owner wants to tell him and if he thinks it will effects his trade in price i bet most would keep mum Thumbs Up

the only chance you might have is to contact the previous owner and ask him if he was asked by the garage if he wasn't you may have a chance of something out of them Whistle rainy-city

My next move would be to contact Land Rover Customer services at their head office and send them a copy of your repairers report and how the vehicle was sold to you. Mention you have already been intouch with the dealer "name and addy" and had little success so would they look into the matter for you.
Apart from that there is little more you can do unless you get legal advice which would cost unless you are an AA or RAC member and see if they can help on the legal front.

Golden rule keep copies of all correspondence.

unless it was a demonstrator vehicle owned by the dealer, you have no chance, as the dealer will just say they had no knowledge of the repairs.

Depends what they mean be "accident free"? if someones been off roading in it and dinged the doors then that could be classed as thats what you should expect might happen and its not an accident, they should have said "damage free".

Thanks for the interest.
The car had been originally purchased through the dealership I bought from. The elderly previous owner had unfortuneatly died suddenly from heart failure. That fact alone prompted me to ask the question about previous damage. Had the circumstances of his death resulted in a car accident?
Whilst it is a fact that none disclosure of an accident would absolve the dealership, I am very concerned that this dealership has not yet found time to contact me regarding this matter. The salesman I dealt with, has moved on.
I honestly did not know what to expect from the dealership, but the repair centre were very surprised at the previous damage. and do have photo evidence.
The original repair had fooled me, but a proffessional would have picked it up according to my repairers.
That also leads me to believe that as the car was local when first bought it should not be too difficult to track down those responsible for that first repair, i don't feel too comfortable approaching the widow.
Its one of those irritations in life that maybe I should just let go.

Depending on the damage done prior to you buying the car, get a garage to check the ECU with a scanner. It might well have logged it in the ECU if any airbags etc etc were activated. The freelander 2 has a type of "blackbox recorder" witch will record what was activated, what speed and a variety of other sensor readings, . this could be helpful to you.
Although the main logs can be cleared there will still be a log with date etc in the memorey

Have you written to the Dealer Principal of the supplying dealer? If not, it may well be worth a go. If the dealership is part of a larger group, eg Stratstones or Inchcape, you could find out the name of the area manager and copy the letter to them. The advice from other members is good, but I would not give up just yet, but I agree it would be uncomfortable for you contacting the widow. OK some movement, I had an email from the dealership, the usual advertiseing about me being a valued customer, and that they wanted my car!
I phoned them, I was put onto the sales manager who apologiosed for not getting back, but would look into the history of the car.
They had done a repair to the door in order to bring it to the standard required by Landrover for re-sale.
He discribed the repair as being cosmetic, ie similar to the door being knocked by a supermarket trolley, such repairs would not in its self require its disclosure at the point of sale.
Also at the first service it was reported that there was a problem with the passenger side door not locking, 'the wiring was kinked' It was fixed, but just another co-incidence?
What car has not sufferred 'minor cosmetic' damage, but the fact remains that sufficient filler had been used on the original repair, that a specialist repair centre would not sanction further similar repairs that could not meet their strict standards.
The sales manager could offer no solution to my concerns about the increased cost of my repairs.
It was left at that whilst I consider my next move

hello, can i ask .. who is the dealer ?
derryk My First Fl2 and it is a 2010 GS Auto in Grey
with Nice Leather and the Stereo
even has headphone sockets in the back.
Wish it had a heated screen tho..
Traded in a Fl1 for this.
Got a georgous Black SoftTailed Harley
for when the days get warmer .. Do days ever get warmer in Lancashire?
